1. Contractual Relationship By accessing the website trofdesign.com (the “Website”) or purchasing services/digital items from Sole Proprietor (FOP) Oleksandr Trofymov (Registration No: 2820005979, Chernihiv, Ukraine), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you must immediately cease using the Website.
2. Scope of Services & Digital Goods We provide professional digital services and products, including but not limited to:
- Custom vector graphic design, brand identity, and vector tracing.
- Technical layouts for CNC machines, laser cutting, and plotters.
- Custom WordPress web development, optimization, and consultation.
- Instant-download pre-made vector assets and digital items.
3. Payment Terms, Revisions, and Refunds
- Pre-made Digital Goods: Standard downloadable assets purchased directly via the Website require 100% upfront payment. Due to the immediate, non-returnable nature of digital downloads, all sales of pre-made assets are final and non-refundable.
- Custom B2B Projects: Custom design or web development projects follow a hybrid payment model. Work begins only after a 50% upfront deposit is cleared, with the remaining 50% balance due upon project completion and before final files or website handoff.
- Invoices: Custom invoices are generated via Stripe or Payoneer. All banking fees or transfer conversions are the responsibility of the client.
- Revisions: The number of included design revisions is defined explicitly in the initial project scope or intake form. Additional revisions requested outside the scope will be billed at an hourly rate or a mutually agreed flat fee.
4. Intellectual Property & Ownership
- Website Content: All text, code, custom layouts, and graphics displayed on trofdesign.com are the exclusive property of Oleksandr Trofymov and are protected by international copyright laws.
- Custom Deliverables: Full commercial ownership and intellectual property rights for custom designs, logos, or web code transfer to the Client only upon receipt of final, full payment.
- Portfolio Rights: We retain the right to display completed designs, vector work, and “before/after” case studies in our professional portfolio for promotional purposes, unless a formal Non-Disclosure Agreement (NDA) is signed prior to project kickoff.
5. Manufacturing and Industrial Limitation of Liability For vector designs intended for production (laser cutting, CNC routers, plasma cutters, plotters):
- We provide technical vector assets designed with professional manual precision. However, the Client is solely responsible for testing, scaling, and verifying the layout on their specific machinery before mass manufacturing.
- We shall not be liable for any material damages, ruined raw materials, hardware failures, physical injuries, or manufacturing costs resulting from architectural software interpretation, incorrect toolpath configurations, or machine operator error.
6. Technical Web Development Limitation of Liability For WordPress and web development projects:
- We ensure that all web builds conform to standard speed, security, and SEO best practices at the time of delivery.
- We are not liable for website crashes, security breaches, database corruption, or plugin conflicts caused after launch by third-party hosting providers, unapproved user modifications, or lack of regular system core updates by the client.
7. Governing Law and Disputes These Terms shall be governed by and construed in accordance with the laws of Ukraine. Any conflicts, claims, or disagreements arising from transactions on this Website shall first undergo a mandatory 30-day amicable resolution process via email. If a resolution cannot be reached, the dispute will be submitted to the competent courts of Ukraine.
